(6)2.1.1 Capital Murder

A person is guilty of Capital Murder under this section if he or she:

(a) unlawfully ends the life of a police officer, fire fighter, emergency medical responder, or court official during the official execution of their duties; or

(b) unlawfully ends the life of a journalist as a direct consequence of their work as a such; or

(c) unlawfully ends the life of another person in the commission of, attempt to commit, or immediate flight from a felony crime of: kidnapping, rape, robbery, arson, human trafficking, or terrorism; or

(d) unlawfully ends the life of a child under the age of 13; or

(e) unlawfully ends the life of more than one person as part of the same course of conduct or scheme; or

(f) unlawfully ends the life of another person after having previously been convicted of Murder in the First Degree or any Class A+ offense; or

(g) unlawfully ends the life of another person through the intentional use of an explosive device, chemical agent, biological agent, or radioactive material; or

(h) unlawfully ends the life of a witness, juror, judge, or attorney as retaliation for their role in an official proceeding, or to prevent their participation; or

(i) unlawfully ends the life of another person as an act of terrorism or to further an act of terrorism; or

Capital Murder is a Class A+ Felony.
