• Competency determinations must respect the defendant’s constitutional rights and ensure procedural fairness.
• In cases of long-term incompetency, the court may consider alternatives including civil commitment or referral to appropriate civil authorities, without violating due process.
• No enhanced penalty or adverse inference shall result solely from a finding of incompetency.
