(4)9.2.1 General Rule

(a) Competency Requirement.

A defendant must be competent to:

• Understand the nature and objectives of the proceedings; and
• Assist counsel in the preparation and presentation of a defense.

(b) Presumption.

All defendants are presumed competent unless evidence demonstrates otherwise.
