(4)6.6.5 Judicial Oversight
(a) General Authority.
The court shall maintain control over the examination of witnesses and presentation of evidence to ensure:
- Compliance with the rules of evidence (Title 4, Chapter 5);
- Fairness and impartiality for all parties;
- Orderly and efficient proceedings; and
- Protection of the jury from undue influence or confusion.
(b) Intervention Powers.
The court may intervene sua sponte or on objection to:
- Prevent improper questioning, harassment, or coaching of witnesses;
- Exclude evidence or testimony that is inadmissible, irrelevant, or unduly prejudicial;
- Limit cumulative, repetitive, or confusing testimony;
- Clarify procedural or evidentiary matters for counsel or the jury; and
- Address violations of courtroom decorum or ethical rules.
(c) Instructions to Jury.
- The court may provide curative instructions if improper evidence or statements are presented.
- The court shall instruct jurors on how to consider or disregard evidence in accordance with rulings and limiting instructions.
- Special instructions may be given regarding the use of expert testimony, character evidence, or other non-propensity evidence.
(d) Sanctions and Remedies.
- The court may admonish, sanction, or bar counsel or witnesses for violations of procedural, evidentiary, or ethical rules.
- The court may recess, strike testimony, or take other measures necessary to preserve the integrity of the trial.
- Judicial rulings under this subsection are binding unless properly challenged or preserved for appeal.
