(4)6.5.1 Purpose of Opening Statements
(a) Overview.
Opening statements provide each party an opportunity to:
- outline the facts they intend to prove;
- explain the elements of the charges or defenses; and
- inform the jury of the sequence and nature of anticipated evidence and witnesses.
(b) Limitations.
- Parties may not argue or comment on the credibility of witnesses during opening statements.
- Statements must be confined to evidence the party reasonably expects to present.
- Improper or inflammatory remarks may be corrected or admonished by the court.
