(7)6.1.2 Duty to Report Collision - Witness
(a) Reporting Requirement.
Any person who witnesses a motor vehicle collision that results in bodily injury or death and who is present at the scene shall report the collision to the appropriate law enforcement agency if no driver at the scene is able or willing to report.
(b) Information to Provide.
The witness must provide the following information when reporting:
- name, address, and contact information;
- description of the collision circumstances;
- identities or descriptions of vehicles and drivers involved, if known; and
- any observed injuries or hazards.
(c) Exceptions.
This subsection does not require reporting if:
- a law enforcement officer is already present and has obtained the necessary information; or
- the witness was not in a position to safely observe the collision.
(d) Penalties.
Violation of the reporting requirements of this subsection constitutes a Level 5 Infraction.
