(7)2.4 Agricultural Exemptions
This section provides limited exemptions to certain provisions of Title 7 for agricultural operations when such exemptions are reasonably necessary to conduct lawful farming or ranching activities.
(7)2.4.1 Scope
(a) This section applies only to vehicles, implements, and operators lawfully engaged in agricultural activity, including farming, ranching, or livestock operations.
(b) Exemptions under this section apply only while directly engaged in agricultural work or traveling a short and direct distance between agricultural properties.
(c) This section shall be narrowly construed to promote public safety and does not create a general exemption from traffic laws.
(7)2.4.2 Authorized Exemptions
An operator may, when reasonably necessary for agricultural purposes:
(a) Operate farm implements or agricultural equipment on roadways not ordinarily permitted for such use;
(b) Travel at reduced speeds or impede traffic while transporting agricultural equipment or livestock; or
(c) Utilize roadways or rights-of-way in a manner incidental to agricultural operations,
provided such actions are conducted with due regard for public safety.
(7)2.4.3 Limitations
(a) This section does not authorize extended travel on high-speed or limited-access roadways unless no reasonable alternative route exists.
(b) Exemptions do not apply to personal transportation, commercial hauling unrelated to agriculture, or general travel convenience.
(c) Operators must use reasonable safety measures, including lighting, markings, or escort vehicles, when practical.
(d) Reckless, negligent, or unsafe operation is not protected under this section.
