A person is guilty of Felony Evading under this subsection if he or she willfully:

(a) knows that they are the subject of a lawful detention, stop, or arrest by a law enforcement officer; and

(b) intentionally flees, attempts to flee, or otherwise avoids being taken into custody or complying with a lawful order to stop using a motor vehicle, motorcycle, bicycle, or any other self-propelled device; and

(c) creates a substantial risk of injury, property damage, or public endangerment during the act of evasion.

(d) This subsection shall not apply where the person reasonably believes that compliance is unnecessary due to lack of legal authority, emergency necessity, or other lawful justification.

Felony Evading is a Class C+ Felony.
