A person is guilty of Evading under this subsection if he or she willfully:

(a) knows that they are the subject of a lawful detention, stop, or arrest by a law enforcement officer; and

(b) intentionally flees, attempts to flee, or otherwise avoids being taken into custody or complying with a lawful order to stop.

(c) This subsection shall not apply where the person reasonably believes that compliance is unnecessary due to a lack of legal authority, emergency necessity, or other lawful justification.

Evading is a Class D Felony.
