(6)6.4.1 Maintaining a Building for Drug Purposes
A person is guilty of Maintaining a Building for Drug Purposes under this subsection if he or she willfully:
(a) owns, leases, rents, occupies, or otherwise controls any building, structure, or premises; and
(b) knowingly permits, facilitates, or maintains the building for the manufacture, distribution, or use of any controlled substance, including marijuana or marijuana extract, in violation of law; or
(c) maintains the premises for the purpose of unlawfully furnishing, distributing, or selling alcohol without lawful authority or permit.
(d) This subsection shall not apply to:
- lawful possession, lease, or use of the premises for activities authorized by law;
- temporary, incidental, or isolated violations by others that the property owner could not reasonably prevent;
- premises maintained under statutory or licensed exemptions.
Maintaining a Building for Drug Purposes is a Class C Felony.
