A person is guilty of Manufacturing a Controlled Substance under this subsection if he or she willfully:

(a) cultivates, synthesizes, produces, prepares, compounds, processes, or otherwise manufactures a controlled substance, including marijuana or marijuana extract; or

(b) produces, brews, distills, or otherwise manufactures alcoholic beverages without lawful authority, permit, or license.

(c) This subsection shall not apply to:

  • lawful cultivation, production, or manufacturing authorized by federal or state law, regulation, or license;
  • production of substances solely for personal use in compliance with applicable legal limits;
  • distribution or manufacture conducted by licensed medical, pharmaceutical, or industrial entities acting within the scope of lawful authority.

(d) Manufacturing under this subsection includes both direct and indirect acts, whether or not the product is intended for distribution, sale, or commercial gain.

Manufacturing a Controlled Substance is a Class C+ Felony.
