(6)4.4.9 Destruction of Roadway Equipment
A person is guilty of Destruction of Roadway Equipment under this subsection if he or she willfully:
(a) damages, disables, tampers with, or destroys any equipment, signage, barrier, or infrastructure used for the safe operation of roads, highways, or bridges; and
(b) does so without lawful authority or consent; and
(c) the act creates a substantial risk to the safety of motorists, pedestrians, or the public, or materially interferes with the lawful operation and safety of roadways.
(d) Definition of “Roadway Equipment”: For purposes of this subsection, “roadway equipment” includes, but is not limited to:
- Traffic signals, lights, and signs;
- Guardrails, barriers, cones, or barricades;
- Roadway lighting, sensors, and detection systems;
- Bridges, tunnels, and associated structural components used for vehicular or pedestrian traffic;
- Maintenance equipment, vehicles, and machinery critical to safe road operation.
Destruction of Roadway Equipment is a Class B- Felony.
