(6)4.4.5 Destruction of Railway Equipment
A person is guilty of Destruction of Railway Equipment under this subsection if he or she willfully:
(a) damages, tampers with, disables, or destroys any railway equipment, track, signal system, or supporting infrastructure used in the operation of rail transportation; and
(b) does so without lawful authority or consent; and
(c) the act creates a substantial risk to the safety of rail passengers, employees, or the public, or materially disrupts the operation of the railway system.
(d) Definition of “Railway Equipment”: For purposes of this subsection, “railway equipment” includes, but is not limited to:
- Locomotives, railcars, or rolling stock;
- Rails, tracks, switches, or crossings;
- Signaling and communication systems integral to rail operation;
- Rail yards, maintenance facilities, and related infrastructure necessary for safe and lawful train operations.
Destruction of Railway Equipment is a Class B Felony.
