(6)8.3.1 Felony Harassment
A person is guilty of Felony Harassment under this subsection if he or she willfully:
(a) makes repeated attempts to contact another person whom has made clear their wishes against such contact; or
(b) makes a threat to harm or otherwise physically injure another person; and
(c) the person harassed or threatened is a protected worker during the lawful execution of their duties.
(d) For purposes of this subsection, “protected worker” includes, but is not limited to:
- Physicians, nurses, emergency medical technicians, and other licensed healthcare providers;
- Firefighters and emergency response personnel (not including law enforcement officers);
- Road construction, traffic control, and road safety workers;
- Public transit operators;
- Utility, infrastructure, or public works personnel performing safety-related duties.
- Any other occupation designated by statute as requiring enhanced protection due to heightened risk while performing essential services.
Felony Harassment is a Class C- Felony.
