A person is guilty of Criminal Possession of Identification Instruments under this subsection if he or she willfully and knowingly:

(a) possesses an identification instrument without the consent of the issuer or lawful holder, knowing that it:

  1. Has been stolen, forged, altered, counterfeited, or obtained by fraud; or
  2. Is intended to be used to defraud or misrepresent identity;

(b) utters, delivers, or transfers an identification instrument described in subsection (a) with knowledge of its unlawful nature and with intent to defraud or deceive another;

(c) it shall constitute a separate criminal offense for each unlawfully possessed identification instrument.

Criminal Possession of Identification Instruments is a Class D+ Felony.
