A person is guilty of Motor Vehicle Theft in the Second Degree if he or she:

(a) willfully and without lawful authority takes a motor vehicle; and

(b) does have intent to permanently deprive the rightful owner of the vehicle.

Taking a Motor Vehicle without Permission is a Class D Felony.
