A person is guilty of Tampering with Evidence under this subsection if he or she:

(a) willfully and knowingly alters, destroys, conceals, removes, or falsifies any physical evidence, digital record, or other thing;

(b) with intent to impair its availability, authenticity, or reliability in an official proceeding, criminal investigation, or law enforcement action; and

(c) at a time when the person knows or reasonably should know that such evidence is relevant to a pending or reasonably foreseeable investigation or proceeding.

Tampering with Evidence is a Class B Felony.
