A person is guilty of Perjury in the First Degree under this subsection if he or she:

(a) Willfully, and with intent to deceive, makes a materially false statement in an official proceeding or record; and

(b) In relation to the case perjured, holds a position of:

  1. Prosecutor; or
  2. Counsel for Defense; or
  3. Judge; or
  4. Probation Officer; or
  5. Parole Officer; or
  6. Law Enforcement Officer; or
  7. Corrections Deputy

Perjury in the First Degree is a Class B+ Felony
