(a) Transition to Sentencing.

  • Following the resolution of post-verdict motions, the court shall schedule sentencing in accordance with Title 4, Chapter 7 (Sentencing Guidelines).
  • Pre-sentencing reports, victim impact statements, and other relevant materials may be prepared and reviewed in advance.

(b) Defendant Rights.

  • The defendant shall be afforded notice of sentencing proceedings and an opportunity to present mitigating factors or allocution.
  • Counsel shall be permitted to submit relevant arguments and evidence regarding sentencing considerations.
