(6)6.1.7 Minor in Possession of Marijuana

A person is guilty of Minor in Possession of Marijuana under this subsection if he or she willfully:

(a) possesses marijuana in an amount exceeding one ounce; or

(b) possesses marijuana concentrate or extract in an amount exceeding seven grams; and

(c) is under the age of twenty-one (21) years at the time of the offense.

(d) This subsection shall not apply to possession that is:

• authorized by a valid prescription or medical authorization issued by a licensed healthcare provider;
• incidental to lawful employment or medical assistance performed under adult supervision; or
• momentary, unknowing, or solely for the purpose of lawful disposal.

(e) No offense under this subsection shall be elevated to a felony based solely on the age of the offender, quantity possessed, or form of marijuana.

Minor in Possession of Marijuana is a Misdemeanor.
