A person is guilty of Enhanced Driving Under the Influence under this section if he or she operates a motor vehicle on a public roadway:
(a) with a blood alcohol concentration level of above 0.16% (0.16 grams of alcohol per 100 milliliters of blood); or
(b) with a blood THC concentration level of above 10 ng/mL; or
(c) commits the offense of (6)5.1.1 Driving Under the Influence resulting in a collision causing serious bodily injury to another person.
Enhanced Driving Under the Influence is a Class D Felony.
