A person is guilty of Unlawful Distribution of Marijuana under this subsection if he or she willfully:
(a) delivers, transfers, sells, gives, or otherwise distributes marijuana or marijuana extract to another person; and
(b) does so knowing the nature of the substance distributed.
(c) Distribution under this subsection includes both direct and indirect transfers, whether or not consideration, payment, or remuneration is exchanged.
(d) This subsection shall not require proof of profit, commercial activity, or intent to distribute beyond the act of distribution itself.
(e) This subsection shall not apply to:
- lawful distribution authorized by statute, regulation, or license;
- conduct constituting mere possession without transfer to another person;
- conduct charged as Unlawful Distribution of a Controlled Substance.
Unlawful Distribution of Marijuana is a Gross Misdemeanor.
