A person is guilty of Assault in the Second Degree under this subsection if he or she assaults another person and:
(a) causes injury to the person; or
(b) assaults a person whom the actor knows or reasonably should know is engaged in the lawful performance of duties as a protected worker, and causes bodily injury.
For purposes of this subsection, “protected worker” includes, but is not limited to:
- Physicians, nurses, emergency medical technicians, and other licensed healthcare providers;
- Firefighters and emergency response personnel;
- Road construction, traffic control, and road safety workers;
- Public transit operators;
- Utility, infrastructure, or public works personnel performing safety-related duties.
- Any other occupation designated by statute as requiring enhanced protection due to heightened risk while performing essential services.
Assault in the Second Degree is a Class C Felony.
