(a) operates a motor vehicle on a public roadway with a blood alcohol concentration level of above 0.08% (0.08 grams of alcohol per 100 milliliters of blood); or
(a) with a blood alcohol concentration level of above 0.08% (0.08 grams of alcohol per 100 milliliters of blood); or


(b) operates a motor vehicle on a public roadway with a blood THC concentration level of above 5 ng/mL; or
(b) with a blood THC concentration level of above 5 ng/mL; or


(c) operates a motor vehicle on a public roadway while intoxicated or chemically impaired under circumstances not amounting to (a) or (b) under this section.

For the purposes of this subsection, "Motor Vehicle" and "Public Roadway" should be interpreted as they are defined under [[(7)1.1_Definitions|Title 7, Chapter 1, Section 1]] of the [[Title 7|Motor Vehicle Code]].

A person is guilty of Driving Under the Influence under this subsection if he or she operates a motor vehicle on a public roadway:

(a) with a blood alcohol concentration level of above 0.08% (0.08 grams of alcohol per 100 milliliters of blood); or

(b) with a blood THC concentration level of above 5 ng/mL; or

(c) while intoxicated or chemically impaired under circumstances not amounting to (a) or (b) under this section.

Driving Under the Influence is a Gross Misdemeanor
