(7)2.2 Life Saving Measures Exemption

This section provides a limited exemption from certain provisions of Title 7 for ordinary citizens who, acting in good faith, take necessary action in the pursuit of life-saving care.

(7)2.2.1 Scope

(a) This section applies only to qualified drivers licensed by the appropriate authority.

(b) Exemptions under this section are limited to actions taken while directly pursuing immediate life-saving care for the driver or another person.

(c) The driver must be acting in good faith and without intent to evade law enforcement or avoid lawful consequences.

(7)2.2.2 Exemption

A driver who:

  1. Has a reasonable belief that the driver or another person is at imminent risk of death or serious bodily harm;
  2. Is a qualified, competent, and licensed driver in accordance with Title 7; and
  3. Is acting in good faith,

may, while maintaining heightened care, caution, and situational awareness, reasonably violate those traffic provisions of this title that are strictly necessary to obtain life-saving care without penalty.

This exemption does not authorize reckless or negligent conduct and shall be exercised in a manner that does not create undue risk of harm to the public or any other person.
