A person is guilty of Minor in Possession of Marijuana under this subsection if he or she willfully:
(a) possesses marijuana in any amount; or
(b) possesses marijuana concentrate or extract in any amount; and
(c) is under the age of twenty-one (21) years at the time of the offense.
(d) This subsection shall not apply to possession that is:
- authorized by a valid prescription or medical authorization issued by a licensed healthcare provider;
- incidental to lawful employment or medical assistance performed under adult supervision; or
- momentary, unknowing, or solely for the purpose of lawful disposal.
(e) No offense under this subsection shall be elevated to a felony based solely on the age of the offender, quantity possessed, or form of marijuana.
Minor in Possession of Marijuana is a Misdemeanor.
