Any driver operating a motor vehicle along a public roadway shall:
(a) not exceed the posted speed limit; or
(b) not exceed a speed of 25mph if no speed limit is posted; or
The Infraction Level for violating the provisions of this section are as follows:
- If the speed limit is exceeded, but not by more than 10 MPH it is a Level 1 Infraction.
- If the speed limit is exceeded by more than 10 MPH, but not more than 20 MPH it is a Level 2 Infraction.
- If the speed limit is exceeded by more than 20 MPH, but not more than 30 MPH it is a Level 3 Infraction.
- If the speed limit is exceed by more than 30 MPH, but not more than 40 MPH, it is a Level 4 Infraction.
- If the speed limit is exceeded by more than 40MPH, it is a Level 5 Infraction or Misdemeanor (see Criminal Code).
