(6)7.1.8 Creating a False Report

A person is guilty of Creating a False Report under this subsection if he or she willfully:

(a) with knowledge that the information is false, makes a file, or submits a written, electronic, or oral report containing material information that is intended to mislead, deceive, or cause another to take or refrain from lawful action.

(b) For purposes of this subsection, a “report” includes statements made to:

• Law enforcement officers or agencies;
• Governmental or judicial authorities;
• Any entity acting under color of law or performing official duties.

(c) Conduct under this subsection does not require proof of intent to commit a felony or to secure a criminal conviction; it is sufficient that the false report is material and intended to influence official action.

Creating a False Report is a Gross Misdemeanor.
