(7)6.2.1 Commercial Vehicle Obligation to Report

(a) Reporting Requirement.

Any driver operating a commercial vehicle, including vehicles carrying heavy machinery or hazardous materials, who is involved in a collision resulting in:

  1. bodily injury or death, or
  2. property damage of any amount or value,

shall immediately stop at the scene and report the collision to the appropriate law enforcement agency and the vehicle’s employer or dispatch office.

(b) Information to Provide.

The driver must provide the following information when reporting:

  1. name, address, and driver’s license number;
  2. vehicle registration and commercial vehicle credentials;
  3. description of the collision circumstances, including cargo or equipment involved;
  4. any injuries sustained by any person involved; and
  5. notification to the employer or dispatch regarding the incident.

(c) Duty to Remain at Scene.

The driver must remain at the scene until:

  1. a law enforcement officer authorizes departure, or
  2. exchange of the required information with all other parties involved is completed, and
  3. employer or dispatch instructions are followed, unless doing so would create an imminent risk of further harm.

(d) Exceptions.

This section does not apply if:

  1. exigent circumstances exist that require the driver to seek immediate medical assistance; or
  2. the collision involves only unattended property and a conspicuous notice is left with the required information.

(e) Penalties.

Violation of the reporting requirements of this subsection constitutes a Level 5 Infraction.
