(6)7.4.3 Capital Treason

A person is guilty of Capital Treason under this subsection if he or she:
(a) owing allegiance to the State, willfully and intentionally commits any act of treason against the State, including but not limited to:
- Levying war against the State or participating in armed insurrection, rebellion, or organized armed resistance against the lawful authority of the State; or
- Adhering to, aiding, or giving aid or comfort to an enemy of the State during a time of war, armed conflict, or declared emergency; or
- Knowingly providing intelligence, classified information, military resources, strategic assistance, or material support to an enemy of the State with intent to harm the sovereignty, security, or constitutional order of the State; or
- Attempting, conspiring, soliciting, or materially assisting another person to commit any act described in this subsection, whether or not such act is successfully completed; or
- Usurping, attempting to overthrow, or forcibly prevent the execution of the Constitution, laws, or lawful governmental authority of the State through force of arms or coordinated violent action.
(b) An act constitutes treason under this subsection regardless of whether the enemy is a foreign power, foreign organization, or domestic force, provided the conduct is directed against the sovereignty or security of the State.
(c) Conduct constituting terrorism or terrorist acts as defined elsewhere in this code shall be prosecuted under those provisions and shall not be charged under this subsection.
Capital Treason is a Class A+ Felony.
