(6)7.3.6 Unlawful Sale of a Firearm in the Second Degree

A person is guilty of Unlawful Sale of a Firearm in the Second Degree under this subsection if he or she:

(a) willfully sells, transfers, delivers, or otherwise furnishes a firearm to another person; and

(b) such sale, transfer, delivery, or furnishing is conducted without complying with the requirements of state or federal law, including required background checks, recordkeeping, waiting periods, or verification of lawful eligibility.
