(6)7.3.5 Unlawful Sale of a Firearm in the First Degree

A person is guilty of Unlawful Sale of a Firearm in the First Degree under this subsection if he or she:
(a) willfully sells, transfers, delivers, or otherwise furnishes a firearm to another person; and
(b) such sale, transfer, delivery, or furnishing is conducted without complying with the requirements of state or federal law, including required background checks, recordkeeping, waiting periods, or verification of lawful eligibility; and
(c) does so with knowledge it is in furtherance of a criminal enterprise or terrorism scheme; or
(d) does so with the knowledge that the receiving person is disqualified from owning or possessing firearms under state or federal law.
Unlawful Sale of a Firearm in the First Degree is a Class C- Felony.
