(6)6.1.6 Minor in Possession of a Controlled Substance

A person under the age of eighteen is guilty of Minor in Possession of a Controlled Substance under this subsection if he or she willfully possesses, uses, or has control over any controlled substance.

(a) Possession under this subsection includes actual possession, constructive possession, or the ability to exercise dominion or control over a controlled substance, whether directly or through another person.

(b) This subsection shall not apply where the controlled substance is lawfully prescribed to the minor and possessed or used strictly in accordance with that prescription.

(c) This subsection shall not apply to possession occurring solely as a result of lawful medical treatment administered by a licensed medical professional.

Minor in Possession of a Controlled Substance is a Gross Misdemeanor.
