(6)6.1.5 Minor in Possession of Alcohol

A person under the age of twenty-one is guilty of Minor in Possession of Alcohol under this subsection if he or she willfully possesses, consumes, or has control over any alcoholic beverage.

(a) This subsection shall not apply where the possession or consumption is:

• limited to a small quantity of alcohol; and
• occurs within a private residence; and
• is with the knowledge and consent of the minor’s parent or legal guardian who is present or has expressly authorized such possession or consumption.

(b) This subsection shall not apply to possession or consumption of alcohol:

• for lawful religious observances; or
• for legitimate medical purposes when prescribed or administered by a licensed medical professional.

(c) For purposes of this subsection, “possession” includes actual possession, constructive possession, or control over an alcoholic beverage, whether opened or unopened.

Minor in Possession of Alcohol is a Misdemeanor.
