(6)6.1.3 Unlawful Possession of Marijuana

A person is guilty of Unlawful Possession of Marijuana under this subsection if he or she willfully possesses marijuana or marijuana concentrated extract in excess of the amounts permitted by law.
(a) A person commits this offense if he or she possesses:
- more than one (1) ounce of marijuana; or
- more than seven (7) grams of marijuana concentrated extract.
(b) This subsection does not apply to:
- persons lawfully authorized to possess greater quantities under state or federal law; or
- licensed producers, processors, distributors, or medical patients acting within the scope of their authorization.
Unlawful Possession of Marijuana is a Misdemeanor.
