(6)5.1.3 Driving Under the Influence, Repeat Offenses

A person is guilty of Driving Under the Influence, Repeat Offenses under this subsection if he or she:

  1. Commits an offense of (6)5.1.1 Driving Under the Influence or (6)5.1.2 Enhanced Driving Under the Influence; and
  2. Has at least two (2) previous convictions for (6)5.1.1 Driving Under the Influence or (6)5.1.2 Enhanced Driving Under the Influence in the last 10 years.

Driving Under the Influence, Repeat Offenses is a Class D Felony.
