(6)4.4.8 Destruction of First Responder Equipment

A person is guilty of Destruction of First Responder Equipment under this subsection if he or she willfully:

(a) damages, disables, tampers with, or destroys any equipment, vehicle, or facility used by first responders in the performance of their duties; and

(b) does so without lawful authority or consent; and

(c) the act creates a substantial risk to the safety of first responders, the public, or the timely provision of emergency services, or materially interferes with lawful emergency response operations.

(d) Definition of “First Responder Equipment”: For purposes of this subsection, “first responder equipment” includes, but is not limited to:

  • Firefighting vehicles, apparatus, and protective gear;
  • Ambulances, medical response vehicles, and associated medical equipment;
  • Police vehicles, communication systems, weapons, and tactical equipment;
  • Dispatch centers, alarm systems, and other facilities critical to emergency response;
  • Any infrastructure or apparatus essential to the safe and effective performance of first responder duties.

Destruction of First Responder Equipment is a Class B Felony.
