(6)4.2.1 Arson in the First Degree

A person is guilty of Arson in the First Degree if he or she willfully:

(a) unlawfully ignites, causes to ignite, or aids in the ignition of any real or personal property without the consent of the owner or lawful possessor; and

(b) such ignition causes damages of one-hundred thousand dollars ($100,000) or greater; or

(c) this offense is committed against an occupied structure, to include a motor vehicle; or

(d) this offense is committed during the commission of another felony crime; or

(e) such ignition causes serious bodily injury or death to any person; or

(f) this offense is committed in cooperation with or furtherance of a criminal organization or terrorism scheme; or

(g) this offense is committed with premeditation or exceptional callousness.

Arson in the First Degree is a Class A- Felony.
