(6)3.2.6 Criminal Possession of Payment Instruments

A person is guilty of Criminal Possession of Payment Instruments under this subsection if he or she willfully and knowingly:
(a) possesses a payment instrument without the consent of the issuer or lawful holder, knowing that it:
- Has been stolen, forged, altered, counterfeited, or obtained by fraud; or
- Is intended to be used to defraud or obtain property or services unlawfully;
(b) utters, delivers, or transfers a payment instrument described in subsection (a) with knowledge of its unlawful nature and with intent to defraud or deceive another;
(c) it shall constitute a separate criminal offense for each unlawfully possessed payment instrument.
Criminal Possession of Payment Instruments is a Class C- Felony.
