(6)2.3.8 Poisoning

A person is guilty of Poisoning under this subsection if he or she willfully:
(a) knowingly introduces, administers, or exposes another person to any poisonous, noxious, or harmful substance; and
(b) does so with the intent to cause, or with reckless disregard for the likelihood of causing, bodily injury, illness, or death; or
(c) does so with the intent to incapacitate, control, or otherwise interfere with the health, safety, or liberty of the other person.
(d) This subsection shall not apply to:
- lawful medical treatment, administration of medications, or chemical agents by licensed healthcare providers within the scope of their professional duties;
- accidental exposure where no willful or reckless intent exists; or
- lawful use of substances in accordance with safety regulations, industrial procedures, or public health directives.
Poisoning is a Class B+ Felony.
