(6)2.1.9 Mishandling of a Corpse in the Second Degree

A person is guilty of Mishandling of a Corpse in the Second Degree under this subsection if he or she willfully:
(a) knowingly disposes of, moves, conceals, or interferes with a human corpse without lawful authority; or
(b) fails to report the death of a person to the appropriate authorities when legally required to do so; or
(c) treats a corpse in a manner that is disrespectful, degrading, or intended to conceal evidence of a crime, but without intent to commit homicide or felony assault.
(d) This subsection shall not apply to:
- lawful handling of human remains by licensed medical professionals, morticians, coroners, or funeral service providers acting within the scope of their duties;
- lawful autopsy, medical examination, or scientific research authorized by law; or
- actions taken pursuant to a court order, governmental directive, or emergency necessity.
Mishandling of a Corpse in the Second Degree is a Class D Felony.
