(6)2.1.8 Mishandling of a Corpse in the First Degree

A person is guilty of Mishandling of a Corpse in the First Degree under this subsection if he or she willfully:
(a) conceals, disposes of, or otherwise interferes with a human corpse with the intent to obstruct justice, conceal a crime, or impede a criminal investigation; or
(b) desecrates, mutilates, or treats a corpse in an exceptionally egregious or offensive manner, intending to insult, intimidate, or terrorize another; or
(c) transports, sells, or uses a human corpse or its parts for unlawful purposes, including trafficking, commercial exploitation, or other criminal activity.
(d) This subsection shall not apply to:
- lawful autopsies, medical examinations, or scientific research conducted by licensed professionals within the scope of their duties;
- lawful funeral, burial, or cremation services performed by authorized personnel; or
- actions undertaken pursuant to court order, government directive, or emergency necessity.
Mishandling of a Corpse in the First Degree is a Class B- Felony.
