A driver shall not operate a motor vehicle on a public roadway unless the vehicle’s seatbelts are fully functional and used in accordance with law. Seatbelt equipment requirements include:

(a) All seatbelts provided by the manufacturer shall be intact, properly mounted, and in good working condition.

(b) Seatbelts shall be capable of securely restraining occupants according to the manufacturer’s specifications.

Violation of this subsection is a Level 3 Infraction.
