(6)7.4.4 Voting Fraud

A person is guilty of Voting Fraud under this subsection if he or she willfully engages in any of the following acts with the intent to affect the outcome of an election, interfere with the integrity of the voting process, or circumvent lawful voting procedures:

(a) False registration or identity fraud:

  1. Registers to vote using false, fictitious, or fraudulent information, or assumes the identity of another person in order to register or cast a vote; or
  2. Votes in an election for which the person is not lawfully eligible (e.g., non-resident, underage, disqualified felon, or non-citizen).

(b) Multiple or fraudulent voting:

  1. Casts, attempts to cast, or causes another to cast more than one ballot in the same election; or
  2. Votes in more than one jurisdiction in the same election knowing that it is unlawful.

(c) Interference with ballots or election materials:

  1. Alters, destroys, conceals, or tampers with ballots, voting machines, absentee ballots, or other official election materials with the intent to affect the outcome; or
  2. Forges or counterfeits official ballots, absentee voting forms, or voter registration documents.

(d) Coercion or vote buying:

  1. Threatens, intimidates, or uses force against any person to influence how they vote, or to prevent them from voting; or
  2. Offers, gives, solicits, or receives anything of value in exchange for a vote or the withholding of a vote.

(e) Fraudulent assistance or facilitation:

  1. Aids, abets, or conspires with another person to commit any of the acts described in subsections (a)–(d); or
  2. Provides false information, guidance, or materials intended to mislead voters, election officials, or registration authorities.

(f) Exceptions / lawful conduct:

  1. Participation in lawful voter assistance programs, election monitoring, outreach, or advocacy is not a violation;
  2. Conduct performed in good faith under a reasonable interpretation of election law is not punishable under this subsection.

Voting Fraud is a Class A Felony.
